"Provisions on Internet Security Protection Technical Measures" will be implemented

The Ministry of Public Security promulgated the "Provisions on Technical Measures for Internet Security Protection" on the basis of extensively soliciting opinions from Internet service units, networking units, relevant experts and relevant government departments. The "Regulations" set forth clear, specific, and operable requirements for Internet service units and networking units to implement security protection technical measures to prevent and stop online criminal activities.

The "Regulations" also emphasizes that the implementation of Internet security measures must not infringe on users' freedom of communication and communication secrets. In addition to the provisions of laws and administrative regulations, no unit or individual may disclose or disclose user registration information without the user's consent.

The main content of the "Regulations"

The "Regulations" includes six aspects including legislative purpose, scope of application, legal responsibilities of Internet service units and network users, and public security organs, requirements for technical measures for security protection, implementation and supervision of measures, and interpretation of related terms and terms. (1) It clarifies that the Internet security protection technical measures refer to the technical facilities and technical means for ensuring Internet network security and information security, and prevent violations of laws and crimes, and stipulates that the responsible subjects responsible for implementing Internet security protection technical measures are Internet service providers and Internet The user, the responsible entity responsible for the implementation of supervision and management is the public information network security supervision department of public security organs at all levels.

(2) It is emphasized that Internet service units and network users should establish a security protection management system to ensure that the implementation of security protection technology measures shall not infringe on users' freedom of communication and communication secrets. Apart from the provisions of laws and administrative regulations, any unit or individual has not The user registration information shall not be disclosed or disclosed with the user's consent.

(3) It stipulates the basic security protection technical measures that Internet service units and network users should implement, and stipulates that Internet access service units, Internet information service units, Internet data center service units, and Internet access service units shall implement each Technical measures for security protection. The technical measures for security protection mainly include: the prevention of computer viruses, the prevention of network intrusion attacks and the prevention of the spread of harmful spam, as well as the technical measures such as the system running time, the user's online login time and the retention of network address records.

(4) In order to ensure the scientific and reasonable and unified specifications of safety protection technical measures, it is stipulated that the safety protection technical measures shall comply with national standards, and those without national standards shall comply with public safety industry standards. In order to discover alarms and warnings in time to prevent online computer viruses, network attacks and the spread of harmful information, it is stipulated that security protection technical measures should have a network interface that conforms to the technical standards of the public safety industry.

(5) In order to ensure the normal operation of security protection technical measures, the "Provisions" stipulate that Internet service units and networked units shall not implement acts that deliberately destroy security protection technical measures, change the function of the measures without authorization, and delete or tamper with the operation records of the measures. At the same time, the "Regulations" as the improvement and supplement of the "Administrative Measures", no longer establish new penalties, violations of the "Regulations" will be punished in accordance with the provisions of Article 21 of the "Administrative Measures".

(6) Clarify the supervision and management responsibilities of public security organs and regulate the supervision and inspection behaviors of public security organs. The "Regulations" stipulate that public security organs shall guide, supervise and inspect the implementation of security protection technical measures for Internet service units and network users within the jurisdiction. At the same time, it stipulates that when public security organs supervise and inspect in accordance with the law, the number of supervisors and inspectors shall not be less than two, and they shall present law enforcement identification documents, and Internet service units and networked units shall send people to participate.
